1. Introduction and Agreement

These Terms and Conditions ("Terms") govern the access and use of Ypies Tech Store ("we", "us", "our"), located at Tokordale Building, 438 Dekgras Rd, Silvertondale, Pretoria, 0184 and online at ypiestechstore.co.za.

By browsing, creating an account, submitting a quotation, or purchasing goods from our website or store, you ("the customer" or "user") accept and agree to be legally bound by these Terms, together with our Warranty & Returns Policy and Shipping Policy.

2. Statutory Rights Under South African Law

Nothing in these Terms is intended to unlawfully limit, exclude, or modify any mandatory statutory consumer rights you hold under South African legislation:

• Consumer Protection Act 68 of 2008 (CPA): All consumers are entitled to goods that are reasonably suitable for the purposes for which they are generally intended, of good quality, in working order, and free of defects. We fully honour the implied warranty of quality under Section 55 and Section 56 of the CPA.
• Electronic Communications and Transactions Act 25 of 2002 (ECTA): Under Section 44 of ECTA, consumers purchasing online are entitled to a 7-day cooling-off cancellation period from the date of receipt of goods, subject to the items being returned unopened, unused, in original packaging, and excluding non-returnable categories such as software licenses.
• Protection of Personal Information Act 4 of 2013 (POPIA): We process, store, and safeguard your personal details strictly in accordance with POPIA. We will never sell, lease, or distribute your private information to third parties without your explicit consent, except as required for order delivery and courier waybills.

3. Pricing, Quotations & Availability

• All prices displayed on the website are quoted in South African Rands (ZAR).
• Errors and Omissions Excepted (E&OE): While we make every reasonable effort to display accurate product descriptions, specifications, and prices, typographical, technical, or clerical errors may occasionally occur. We reserve the right to decline, cancel, or refund orders placed on items displaying an obvious error in pricing or specifications.
• Quotations issued directly to clients are valid for a period of 24 to 48 hours (unless otherwise stated in writing), due to fluctuating component availability and supplier import exchange rates.
• Stock is subject to availability. An order is only confirmed once payment has been received and verified.

4. Orders, Payment & Contract Formation

Placing an item in your shopping cart or creating a quote does not constitute a completed sale or reserve stock. An order becomes a binding sales contract when:

• You complete the checkout process and receive an electronic order confirmation and invoice; and
• Payment is successfully cleared in our bank account (for EFT payments, proof of payment may be submitted to sales@ypiestechstore.co.za, and goods are released once cleared by the bank).

We accept Electronic Funds Transfer (EFT) and secure South African debit/credit card payments. We do not extend credit terms to retail customers unless pre-approved via written commercial agreement.

5. Delivery & Collection

We deliver door-to-door nationwide across South Africa via reputable courier partners. Standard expected delivery times are:

6. Warranty, Repairs & Returns

All products sold by Ypies Tech Store carry warranty protection. All warranties are operated on a Return-to-Base (RTB) basis:

• Brand-New Items: Carry a standard 12-Month hardware warranty.
• Used & Refurbished Items: Carry a 3 to 12-Month hardware warranty depending on component age and type (as stated on your purchase invoice).
• Within 7 Days of Receipt: Any confirmed faulty item is eligible for an immediate full cash refund or direct replacement at the customer's choice. We cover all associated shipping costs for confirmed defects.
• After 7 Days: Items confirmed faulty are eligible for repair, replacement/swap, or store credit (no cash refunds).

7. Software & Digital Licenses

All software licenses (including Microsoft Windows operating system keys, Microsoft Office, digital game codes, or downloadable software) are strictly non-refundable and non-exchangeable once issued or activated, in accordance with Section 42 of ECTA.

Operating system corruptions, third-party software incompatibilities, malware/viruses, and software driver conflicts do not constitute hardware defects under any hardware warranty.

8. Limitation of Liability & Customer Data

To the maximum extent permitted by South African law, Ypies Tech Store, its directors, employees, and agents shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use any product.

9. Governing Law and Legal Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the Republic of South Africa.

You consent to the non-exclusive jurisdiction of the Magistrates' Court or High Court of South Africa (Gauteng Division, Pretoria) for any proceedings arising out of these Terms.
